O R D E R
This Criminal Original Petition has been filed seeking to quash the FIR in Crime No.176 of 2025, dated 22.05.2025, on the file of the first respondent police, registered against the petitioners for the offences punishable under Sections 464, 465, 468, 417, 420, and 120B of the Indian Penal Code, 1860.
2. The allegation is that the petitioners, without the knowledge of the second respondent/defacto complainant, had sold the property of the second respondent/defacto complainant to third parties.
3. Admittedly, the first petitioner and the second respondent/defacto complainant are siblings, and the second petitioner is the wife of the first petitioner.
4. The learned counsel for the petitioners would submit that pursuant to the registration of the impugned FIR, the parties have arrived at a compromise and have also decided to give a quietus to the entire dispute.

5. The learned counsel for the second respondent/defacto complainant would confirm the said compromise. He has also filed an affidavit of the second respondent. The relevant paragraphs in the said affidavit read as under:
"4. I respectfully submit that thereafter our well wishers of the family members and relatives are advising me and the 1st petitioner to settle the disputes amicably. Based on that settlement arrived between us, as per settlement, I have executed a release deed in respect of S.F.No.68/2B to an extent of 53 cents in favour of the 1st petitioner herein and same was duly registered on the file of the Sub Registrar Office, Pattukottai dated 11.09.2025.
5. I respectfully submit that as per settlement a the 1st petitioner has executed settlement deed in respect of S.F.No.70/18, S.F.No.70/1B, S.F.No.70/2A, S.F.No. 70/2B, S.F.No.70/3A and S.F.No.70/3B totally to an extent of 60.51 cents in favour of me and same was duly registered on the file of the Sub Registrar Office, Pattukottai dated 11.09.2025.
6. I respectfully submit that in view of the above facts, our disputes are amicably settled out of the court and there is no dispute as on date. Hence I have no objection to quash the F.I.R. in Crime No. 176 of 2025 on the file of the 2nd respondent, pending against the petitioners herein."
6. The learned counsel for the second respondent/defacto complainant would submit that the actual extent of the property is 57 Page No. 3 of 5
cents and not 53 cents, as wrongly stated in the affidavit filed by the second respondent; and that, similarly, in the fourth line of paragraph 6 of the affidavit, it has been wrongly stated as "2nd respondent" instead of "1st respondent.

In view of the compromise and considering the fact that the dispute between the siblings has been settled, this Court is of the view that no useful purpose would be served by keeping the impugned FIR pending trial. Accordingly, the impugned FIR in Crime No.176 of 2025, dated 22.05.2025 is quashed and the Criminal Original Petition stands allowed.
