illegal and consequently directing the respondent to pay the interest for the period from 01.09.2012 to 06.02.2019 with interest of 10% per annum as per the G.O.Ms.No.527, Finance (Pension) dated 15.06.1987 and G.O.Ms.No.122, Finance (Pension) dated 20.02.1995.

O R D E R
Under the impugned order dated 03.12.2020, the first respondent has rejected the petitioner's request to pay interest for the delayed payment of gratuity from 01.09.2012 to 06.02.2019. However, the impugned order dated 03.12.2020 passed by the first respondent is a non-speaking order, since the contentions of the petitioner has not been considered. Further, it is also brought to the notice of this Court that the second respondent who has been newly impleaded as party respondent in this Writ Petition is the competent authority to consider the request of the petitioner for payment of interest for the delayed payment of gratuity from 01.09.2012 to 06.02.2019.

2.Learned Counsel for the petitioner would also submit that the impugned order passed by the first respondent can be quashed and the petitioner may be permitted to give fresh representation to the second respondent seeking for payment of interest for the delayed payment of gratuity from 01.09.2012 to 06.12.2019 and a direction may be issued to the second respondent to pass final orders on merits and in accordance with law on the said request, within a time frame to be fixed by this Court.
3.No prejudice will be caused if such a direction is issued, that too, when the impugned order passed by the first respondent is a non-speaking order. Hence, the impugned order dated 03.12.2020 passed by the first respondent is hereby quashed and the petitioner is permitted to send a representation to the second respondent, who is the competent authority for payment of gratuity as prayed for in this Writ Petition from 01.09.2012 to 06.02.2019, within a period of two [2] weeks from the date of receipt of a copy of this order. On receipt of such representation, the second respondent shall pass final orders on merits and in accordance with law on the said representation, within a period of six [6] weeks, thereafter. 3/6
4.With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
