ORDER

The petitioner seeks transfer of H.M.O.P.No.47 of 2018 from the file of the Sub Court, Paramakudi to the file of the Sub Court, Madurai.

2. The original petition in H.M.O.P.No.47 of 2018 has been filed seeking divorce under Section 13 (1)(ia) of the Hindu Marriage Act by the husband. It is seen from the long cause title in H.M.O.P.No.47 of 2018, the petitioner / first respondent is the resident of Nagamalai Pudukottai Village in Madurai District. Though the respondent is a permanent resident of Virathakulam at Ramanathapuram District, he is at present working at Chennai. Therefore, there will be no inconvenience caused to the respondent by transferring the original petition pending on the file of the Sub Court, Paramakudi to Sub Court Madurai.

3. Considering the fact that the petitioner / wife is residing at Madurai and taking into account the convenience of both parties, I am of the considered opinion that H.M.O.P.No.47 of 2018 on the file of the Sub Court, Paramakudi, can be transferred to the file of the III Additional Sub Court, Madurai for disposal.

4. Accordingly, this Transfer Petition is allowed and https://hcservices.ecourts.gov.in/hcservices/ 1/2

TR.C.M.P.(MD) No.375 of 2019 H.M.O.P.No.14 of 2018 is withdrawn from the file of the Sub Court, Paramakudi and transferred to the file of the III Additional Sub Court, Madurai to be disposed of in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
