ORDER

The writ petition is filed seeking a direction to the respondent to issue patta to the petitioner by considering the petitioner's application dated 12.06.2018 within the stipulated time.

2. Heard the arguments of Mr.C.Jeganathan, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondent. By consent, this writ petition is taken up for final disposal.

According to the petitioner, the land measuring an extent of 8.32 acres comprised in S.No.338 situated at Veeraraghava Mudaliyar Chatram Village was plotted out by the Palayamkottai Municipality, and plot No.141 was purchased by the petitioner's predecessor in interest, namely, H.Nazarbabu, from the Commissioner, Palayamkottai Municipality, under a registered sale deed dated 28.07.1975. Subsequently, the petitioner purchased the said property from the said Nazarbabu through a registered sale deed dated 03.10.1979. The petitioner had put up a residential house, and the same was also assessed for tax. Since the patta for the subject property has not been given to the petitioner, he submitted the instant representation on 12.06.2018 seeking issuance of a separate patta. The same has not been considered. Hence, the petitioner has come before this court.

4.The learned counsel for the petitioner submits that, pursuant to the application submitted by the petitioner, the Tahsildar, Palayamkottai, has already submitted a report to the respondent. However, despite the same, the respondent has not yet considered the petitioner's application. 2/5

The learned Additional Government Pleader appearing for the respondent submits that, as per the revenue records, the subject property is classified as Sarkar Poramboke under the jurisdiction of the Palayamkottai Municipality. Therefore, the request made by the petitioner will be considered in accordance with law.

6. It is seen from the typed set of papers that the Tahsildar by his proceedings No.Na.Ka.AA8/776/2019 dated 18.02.2020 submitted his recommendations to Sub Collector, Tirunelveli. The Sub Collector also in his proceedings in Mu.Mu.A3/756/2021 dated 26.06.2021 submitted his report to the respondent as early as on 26.06.2021.

In such circumstances, without expressing any opinion on the merits of the matter, the respondent is directed to consider the application of the petitioner dated 12.06.2018 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, and other interested parties.
