Respondent/Complainant PRAYER: Petition is filed under Section 482 of Cr.P.C, to call for the records relating to order passed in Cr.M.P.No.6452 of 2005 in S.T.C.No.6089 of 2004, dated 06.09.2007 on the file of the learned Judicial Magistrate No.II, Nagercoil and the consequential confirmation order passed in Crl.R.P.No.2 of 2008, dated 25.03.2015 on the file of the Court of Sessions Kanyakumari Division at Nagercoil and to set aside the same.

ORDER

This petition is filed to quash the order passed in Cr.M.P.No.6452 of 2005 in S.T.C.No.6089 of 2004, dated 06.09.2007 on the file of the learned Judicial Magistrate No.II, Nagercoil. 2.When the matter was posted for admission on 21.07.2015, the learned counsel appearing for the petitioner took adjournment. Thereafter, more than three occasions, when the matter was listed, the learned counsel for the petitioner took adjournments only. Therefore, the matter is pending for the past three years without even ordering notice or admitting by this Court. 3.It seems that the petitioner has no interest to proceed with the matter. More over, the case is of the year 2015. Therefore, this Court is of the view that the pendency of the criminal original petition would not serve any purpose.
