ORDER

The petitioner has approached this Court to quash the FIR registered against him in Crime No.90 of 2015 on the file of the 1st respondent.

2.The learned counsel for the petitioner submits that the petitioner is a subordinate staff and he has taken the cash, according to the directions of his Manager and given it to him. He has taken the cash not for his usage.

3.The learned Government Advocate (CrlSide) on instructions submits that they are having the CCTV footage which shows that the petitioner has taken the cash from the cash box and the investigation is pending.

4.This Court considered the rival submissions made. 5.The petitioner claims that he has committed the mistake only on the direction of his superior. The police claim that they are having CCTV footage and the investigation is pending.

6.The grounds raised by the petitioner are matter for investigation. The investigation is a process of finding truth. The investigation officer shall not conduct the investigation based on the complaint and the witnesses produced by the complainant alone. The investigating officer has to conduct the investigation in a fair and proper manner by considering the grounds raised by the petitioner.+ 7.With the hope that the investigation in this case would be conducted in a fair manner, this Criminal Original Petition is closed. If any final report is filed, it is open to the petitioner to challenge the same in the manner known to law. Consequently connected miscellaneous petition is closed.
