O R D E R

The petitioner herein is the complainant in S.T.C.680 of 2012 on the file of the Judicial Magistrate, Pudukkottai.

2. The said complaint has been filed under Section 138 of the Negotiable Instruments Act. In view of the Judgment of the Hon'ble Supreme Court reported in (2014) 3 MLJ (Crl) 475 (SC) (Dashrath Rupsingh Rathod V. State of Maharashtra), the complaint was returned for presentation before the Court of appropriate jurisdiction. This order is under challenge in this criminal original petition.

3. In view of the subsequent statutory amendment, the order impugned in this criminal original petition will have to be set aside. It is accordingly set aside. The criminal original petition stands allowed, accordingly.
