ORDER

This Contempt Petition has been filed to punish the contemnor/respondent for wilfully disobeying and not complying with the order of this Court passed in W.P(MD) No.12049 of 2022, dated 16.06.2022. 2.Heard Mr.P.Kanagaraj learned counsel representing Mr.K.K.Samy, learned counsel for the petitioner and Mr.Ramachandra Pradeep, learned Standing Counsel for the respondent.

3.This Court, vide judgment and order dated 16.06.2022, had disposed of the said writ petition with the following directions:- "5.In view of the entitlement of the petitioner to withdraw his contribution for the purpose of meeting the medical expenses of his mother, there shall be a direction to the respondent herein to consider the petitioner's application, dated 01.06.2022, along with the supporting documents and grant a loan of Rs.5,00,000/- (Rupees Five Lakhs only) out of the petitioner's Provident Fund account within a period of two (2) weeks from the date of receipt of a copy of this order." 4.The learned counsel for the petitioner submits that despite the judgment and order passed by this Court in W.P.(MD)No.12049 of 2022, dated 16.06.2022, the respondent has not complied with the directions of this Court and has wilfully and deliberately flouted the order passed by this Court and is in contempt of the order of this Court dated 16.06.2022. Thus, he 2/6

should be summoned and punished by exercising the powers under Sections 11 and 12 of the Contempt of Courts Act, 1971. 5.Today, when the matter is taken up, Mr.Ramachandra Pradeep, learned Standing Counsel for the respondent has produced a copy of the order dated 07.07.2025 passed by the Assistant Manager (Legal), Madurai Region, in which it has been stated that the direction issued by this Court, vide order dated 16.06.2022, in W.P.(MD) No.12049 of 2022 has been fully complied with and the petitioner was granted a loan amount of Rs.5,00,000/- (Rupees Five Lakhs only) out of his Provident Fund Account. A copy of the order passed by the Assistant Manager (Legal), Madurai Region, dated 07.07.

2025 has been produced before this Court, which is now taken on record and a copy of the same has also been given to the learned counsel for the petitioner. Thus, he submits that the respondent may be discharged from the present contempt proceedings, as the judgment and order of this Court in W.P.(MD) No.12049 of 2022, dated 16.06.2022 has been fully complied with by the Assistant Manager (Legal), Madurai Region, vide order dated 07.07.2025.

6.Mr.P.Kanagaraj learned counsel representing Mr.K.K.Samy, learned counsel for the petitioner submits that he has received a copy of the order passed by the Assistant Manager (Legal), Madurai Region, dated 07.07.2025 3/6

and has no objection, if the respondent is discharged from the contempt proceedings, as the judgment and order of this Court dated 16.06.2022 has been complied with, vide order dated 07.07.2025. He further submits that the petitioner has also been granted a loan amount of Rs.5,00,000/- (Rupees Five Lakhs only) out of his Provident Fund Account. 7.Accordingly, in view of the submissions made by the learned counsels for the parties and after perusal of the records and the order passed by the Assistant Manager (Legal), Madurai Region, dated 07.07.2025 and also considering the fact that the petitioner has been granted a loan amount of Rs.5,00,000/- (Rupees Five Lakhs only) out of his Provident Fund Account, this Court satisfied that the direction issued by this Court in W.P.(MD) No. 12049 of 2022, dated 16.06.

2022 has been fully complied with by the respondent and thus, no useful purpose will be served in continuing the present contempt proceedings against the respondent. 8.Accordingly, the Contempt Petition is finally disposed of and the respondent is discharged from the present contempt proceedings. No costs. The file is consigned to record.
