Respondents PRAYER:- This Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order dated 27.03.2001 on the file of the 1st respondent in Na.Ka.No.A5/1417/2000 and quash the same and also such other order directing the 2nd respondent to give all terminal benefits with full pension to the petitioner.

ORDER

This Writ Petition has been filed to quash the impugned order dated 27.03.2001 passed by the 1st respondent in Na.Ka.No.A5/1417/2000 and direct the 2nd respondent to give all terminal benefits with full pension to the petitioner.

2. It is made clear that in the year 2001 the petitioner has challenged the said impugned order in O.A.No. 3664 of 2001, which was converted into Writ Petition in W.P.No. 2323 of 2006 https://hcservices.ecourts.gov.in/hcservices/

W.P(MD)No.1330 of 2014 (T) and the same has been dismissed as infructuous, as per the statement of the petitioner in the year 2011. Thereafter, the petitioner has filed the present Writ petition in the year 2014 for the very same prayer. When the impugned order passed by the Revenue Divisional Officer not allowing the petitioner to retire, without challenging the same, the petitioner has filed the present Writ Petition before this Court.

3. Now, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this Writ Petition with liberty to file a fresh Writ Petition.

4. In view of the endorsement made by the learned counsel appearing for the Writ Petitioner, this Writ Petition is dismissed as withdrawn. However, liberty cannot be granted by this Court. No costs. Consequently, connected Miscellaneous Petitions are closed.
