ORDER

The Contempt Petition has been filed to punish the contemnor for his wilful disobedience of the order passed by this Court in W.P.(MD)No. 20459 of 2024 dated 29.08.2024.

It is evident from the records that this Court in W.P.(MD)No. 20459 of 2024 passed an order dated 29.08.2024 directing the second respondent therein to issue notice to the petitioner as well as to the third respondent and consider the petitioner's representation taking note of the order passed by the RDO and pass orders within a period of two weeks from the date of receipt of copy of that order. But the learned counsel appearing for the contemnor would submit that the District Collector in the appeal filed challenging the order of the RDO passed an order dated 23.08.2024 permitting the third respondent to remain in that house but not to cause any interference to the petitioner herein, but in pursuance of the direction of this Court, the contemnor, after conducting some enquiry, passed an order dated 21.10.2024 stating that since the divorce case was pending, the third respondent could not be evicted and on that ground, the complaint was ordered to be closed.

3. But it is pertinent to note that the contemnor has not referred the order passed by the District Collector. Whatever it is, since the RDO order was confirmed by the District Collector, the parties are duty bound to follow the said order and in case of violation of the said order, the parties are at liberty to approach the jurisdictional police.

4. With the above observation, this Contempt Petition stands closed.
