ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ on hand has been instituted, challenging the notice issued under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 (hereinafter referred to as 'the Act').
2.The petitioner has admittedly submitted his explanation. The learned counsel appearing for the petitioner would submit that the final notice under Section 6 of the Act was also issued. If so, the petitioner has to prefer an appeal 2/5
under Section 10 of the Act before the appellate authority. In any event, this Writ Petition is not maintainable and more so, the authorities competent have already identified the encroachment. That being so, there is no impediment for the respondents to continue the enforcement action. The petitioner is at liberty to approach the appellate authority under the Act. 3.With the above observation, this Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
