... Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents herein to earmark by measuring schedule of house site patta allotted to the 2/6

petitioners and also issue E-Patta pursuant to proceeding 1st respondent in Na.Ka.No.41221/2022/B.C5 dated 24.09.2002.

ORDER

The petitioners herein seeks direction to the respondents to measure the property allotted to the petitioners under order of the 1st respondent dated 24.09.2022 in Na.Ka.No.41221/2022/B.C5 and issue E-Patta to their names.

2. Heard the learned counsel appearing for the petitioners and Mr.A.Baskaran, learned Additional Government Pleader who takes notice for the respondents.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself. 3/6

According to the petitioners, free house site has been issued in favour of the petitioners and others in respect of the land situated in S.No.154/3, Semppatti, Usilampatti Taluk, Madurai District, by the order of the 1st respondent dated 24.09.2022. However, E-Patta has not been issued in favour of the petitioners by identifying the allotted house sites. Therefore, the petitioners submitted a representation on 21.08.2023 seeking issuance of E-Patta by identifying the house sites allotted to the petitioners. The same has not been considered, hence, the petitioners have come before this Court.

5. The learned Additional Government Pleader who takes notice for the respondents would submit that the representation submitted by the petitioners dated 21.08.2023 is under consideration of the 1st respondent and final orders will be passed within the time stipulated by this Court.

In view of the same, without expressing any opinion on the merits of the matter, the 1st respondent is directed to consider the representation of the petitioners dated 21.08.2023 and pass final orders on its own merits and in accordance with law, within a period of twelve (12) weeks from the 4/6

date of receipt of a copy of this order, after affording a reasonable opportunity to the petitioners and other interested parties.

7. The writ petition is disposed of with the above observations. No costs.
