None appears for the petitioner.

The learned Standing Counsel appearing for the HDFC Bank informs the Court that the petitioner borrowed a sum of Rs.5,70,000/- (Rupees Five Lakhs Seventy Thousand only) in the year 2013 for purchase of Tractor. The petitioner did not make any payment at all towards clearing the loan liability. He voluntarily surrendered the Tractor. The Bank, thereafter, sold the Tractor for a sum of Rs.3,90,000/- (Rupees Three Lakhs Ninety Thousand only). When the Bank demanded payment of the balance amount with interest from petitioner, the present writ petition came to be filed. 2/4
3. From the submissions of the learned Standing Counsel, I can only conclude that the very filing of this writ petition is an abuse of process. It is seen from the writ averments that the petitioner had not paid even a single installment. No relief can be granted at the instance of a rank defaulter.
