ORDER

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned Central Government Standing Counsel appearing on behalf of the first respondent and the learned Government Advocate appearing on behalf of the second respondent.

2. The petitioner has approached this Court seeking Writ of Mandamus to the respondent No.1 to issue a fresh passport to the petitioner based on petitioner's application, dated 17.06.2025.

3. The petitioner is 26th accused in Crime No.207 of 2024, dated 22.06.2024 on the file of the second respondent Police Station for the offences punishable under Sections 143, 341 and 353 of IPC.

4. It is confirmed by the learned counsel for the second respondent that pursuant to the FIR registered in Crime No.207 of 2024, no charge sheet has been filed against the petitioner and others and the case is still under investigation.

Having considered the submissions made by the learned counsel for the petitioner and the learned counsel for the respondents and I am of the view that there can be no impediment for directing the first respondent to issue a fresh passport to the petitioner by processing the passport application of the petitioner, dated 17.06.2025.

6. The first respondent is directed to process the passport application of the petitioner within a period of three months from the date of receipt of copy of this order. In case charge sheet is filed by the second respondent before the concerned Court, the passport which is to be issued to the petitioner shall be surrendered to the concerned Court and the petitioner shall retrieve the same after filing appropriate application before the concerned Court as and when the petitioner proposes to travel abroad.
