O R D E R
[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This Habeas Corpus Petition has been filed for issuing a direction to the respondents 1 and 2 to produce the body or person of the petitioner's daughter viz., Madhumitha aged 15 years, before this Court and hand over the custody to the petitioner.
2. The case of the petitioner is that her minor daughter aged about 15 years was studying 9th Std., in a school and that she need to go to school in morning and return back at 5.30 pm regularly. On 07.07.2025 she went to school as usual, and she did not return back to the house. Upon enquiry, the petitioner came to know that her minor daughter was kidnapped by the 3rd respondent. Hence, the petitioner had approached the respondent Police. Based on the complaint given by the petitioner, case has been registered in Crime No. 60 of 2025 for "Girl Missing". Since no action has been taken by the respondent Police, the petitioner has approached this Court.
3. The learned Additional Public Prosecutor appearing for the respondent Police would submit that based on the complaint given by the petitioner, a case Page No.2 of 4
was registered in Crime No.60 of 2025 for " Girl Missing". He would further submit that during the course of investigation, the girl along with 3rd respondent was secured at Trichy. Further, the respondent Police are conducting further investigation.
4. Today, the girl was produced before this Court. On enquiry she informed that she has gone due to hardship and she expressed her willingness to go along with her mother.
