ORDER : The Court made the following order :- The petitioners/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 379 IPC r/w 21(1) of Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.497 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 27.08.2022, the accused persons were found in possession of thirty bags of sand, without any valid permit. Hence, the complaint.

3. On the side of the petitioners, it is stated that the petitioners are innocents and not committed any such offence, as alleged by the prosecution. Hence, prays to release them on anticipatory bail.

4. On the side of prosecution, it is stated that first and second petitioners are having one previous case and the third petitioner is having three previous cases, at their credit and prayed to dismiss the petition.

CRL OP(MD). No.16061 of 2022 5.Considering the nature of the case and fact that the petitioners are having previous cases at their credit, this Court is not inclined to grant anticipatory bail to them.

6. Accordingly, this Criminal Original Petition stands dismissed.
