PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 herein to take appropriate action against the respondents 3 to 5 for not providing the Community Certificate and Income Certificate within time based on the petitioner's representation dated 06.03.2014.

ORDER

The present Writ Petition has been filed seeking for a Mandamus to direct the respondents 1 and 2 herein to take appropriate action against the respondents 3 to 5 for not providing the Community Certificate and Income Certificate within time based on the petitioner's representation dated 06.03.2014.

2. The case of the petitioner is that the petitioner had made an application for issuance of Community Certificate and Income Certificate 2/5

by his application dated 31.12.2013. The same was not considered. In the interregnum the petitioner also made an application under the Right to Information Act seeking for certain information. The respondents 3 to 5 had been compelling the petitioner to withdraw the Right to Information Act application, failing which they would not issue the certificates. But the Certificates have not been issued on time. Due to the delay in issuance of the said Certificates, the petitioner was unable to avail loan from THADCO and therefore, he made a fresh representation to the first and second respondents on 06.03.2014 seeking to take action against the respondents No. 3 to 5. As no action was taken, he was constrained to file this petition.

Without going into the averments made in the affidavit filed in support of the writ petition and considering the limited relief, the petitioner is directed to make a fresh representation to the first respondent within a period of two weeks from the date of receipt of a copy of this order and the first respondent is directed to consider the representation of the petitioner and pass appropriate orders on merits and in accordance with law within a period of eight (8) weeks thereafter.
