ORDER

The petitioner filed W.P.(MD)No.13128 of 2024 for re-issuance of his passport. It was brought to the notice of this Court that the criminal case is pending against the petitioner at trial stage. Hence, the petitioner was asked to go before the trial magistrate. The petitioner moved the learned trial magistrate who directed the passport officer to renew the petitioner's passport. The petitioner feels aggrieved that the authority has restricted the validity period upto one year. In this back ground, this review application has been filed.

2. The order passed by me does not suffer from any error apparent on the face of the record. The authority also cannot be faulted. Whenever criminal case is pending against an applicant, the authority cannot be expected to issue passport for a period of ten years. It will be 2/4

only for a period of one year. However, this period can be enlarged by the court.

3. Considering the special facts and circumstances of this case, I direct the first respondent to renew the passport for a period of three years. The petitioner has to comply with the usual formalities. The review application is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
