PRAYER :- For Bail in Cr.No.946 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 29.09.2021 for the offences punishable under Sections 294(b) and 307 IPC @ 294(b), 307, 341 and 394 IPC in Crime No.946 of 2021 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that there was business enmity between the petitioner and the de-facto complainant and on 08.09.2021, the petitioner attacked the de-facto complainant by using aruval. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 29.09.2021. Hence, he seeks for grant of bail.

4.The learned Additional Public Prosecutor for the respondent police would submit that the petitioner was ordered to be detained as Goondas under Act 14 of 1982, dated 11.11.2021 passed by the District Collector and District Magistrate, Thanjavur District. 5.Considering the seriousness and gravity of the offence alleged and also the facts that the petitioner is in judicial custody from 29.09.2021, that the investigation is pending and that the petitioner was detained under Act 14 of 1982 on 11.11.2021 as stated by the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioner at that point of time. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 12/11/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
