To set aside the Judgment and decreetal order dated on 01.02.2014 passed in MCOP No.29 of 2013 on the file of the Special District Judge for MCOP Cases, Madurai and enhance the claim amount and proper in the circumstance of the case.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.R.VENKATESAN, Advocate for the petitioner, the court made the following order:- This Petition is filed seeking to condone the delay of 641 days in filing the above Civil Miscellaneous Appeal. 2.Heard the learned counsel appearing for the petitioner and perused the materials placed before this Court. 3.Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 641 days in filing the above Civil Miscellaneous Appeal is condoned. on condition that the petitioner shall pay a sum Rs.500/-(Rupees Five Hundred Only) to https://hcservices.ecourts.gov.in/hcservices/ 1/2
CMP(MD) No.4472 of 2016 the learned counsel for the respondent, towards costs, within a period of two weeks from the date of receipt of a copy of this order, failing which, this Petition shall stand automatically dismissed without further reference to this Court. 4.Registry is directed to number the appeal, if it is otherwise in order and list it for admission in the usual course. Further, it is made clear that the claimant is not entitled for any interest for the delay period of 641 days in filing the above appeal before this Court.
