O R D E R

This writ petition has been filed for a writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order passed by second respondent in his proceedings in Na.Ka.No. 7271/B3/24 dated 27.05.2025 and quash the same as illegal and unconstitutional and consequently directing the second respondent to settle and disburse the all the Death Cum Retirement Gratuity with all retirement benefits including surrender and encashment of earned leave salary, unearned leave salary on private affairs, commuted value of 2/5

pension, family security fund, family pension, pension arrears and all other attendant retiral benefits and arrears payable to Late.Ravichandran, husband of the petitioner based on the petitioner's representation dated 24.05.2025 within the time stipulated by this Court. 2.Under the impugned order, the petitioner was directed to produce the legal heir certificate of the deceased employee for grant of terminal benefits of the deceased employee and also the family pension. It is not in dispute that the deceased employee had filed nomination forms as required under the Tamil Nadu Pension Rules. The said forms were also produced before this Court and on perusal of the same would also indicate that his family consists of the petitioner and the third respondent. The deceased employee had nominated both the petitioner and the third respondent to be entitled to equal share in his terminal benefits.

3. In view of the same, the impugned order is set aside and the official respondents are directed to disburse the terminal benefits of the deceased employee to the petitioner and the third respondent in equal 3/5

shares, in honouring the nomination made by the deceased employee. The official respondents shall also disburse the family pension to the petitioner, who is shown as the wife of the deceased employee.

4. In fine, the writ petition stands allowed. There shall be no order as to costs.
