ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the 2nd respondent to register and release the sale deed, dated 25.06.2025, presented on 23.06.2025 under Receipt No.2637/2025, within a time frame as may be fixed by this Court.

2.While issuing the receipt for accepting the document, the respondents have stated that since there is a third party objection, it is kept pending. It is a settled proposition of law that if a third party has submitted any objection, the same cannot be a reason to refuse registration. Even if it is a temple or Waqf Board or any Government property, then also the respondents are bound to conduct an enquiry. If it does not belong to the temple property or other property, the respondents shall proceed to register the document. The respondents cannot refuse registration by merely citing an objection. 3.Therefore, the respondents are directed to consider the petitioner's document and register the same as per law without citing the reason as third party objection.

However, if the other conditions are complied with, the document shall be registered within a period of four weeks from the date of receipt of a copy of this order. The said document shall also be released, if it is in accordance to law. 4.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
