O R D E R

This writ petition has been filed for the issue of a writ of mandamus, directing the first and second respondents to consider the representation made by the petitioner on 18.08.2021, wherein, the petitioner is seeking for the modification of the extent mentioned in patta No.235, that was granted in favour of the father of the third respondent and to separately show the pathway, which, according to the petitioner, was included in the patta that was granted in favour of the father of the third respondent.

2.The learned Government Advocate appearing on behalf of the first and second respondents produced the relevant record signed by the Village Administrative Officer before this Court. The said record shows the extent, to which, patta was granted in favour of the father of the third respondent.

3.The specific case of the petitioner is that the father of the third respondent had purchased only two cents of the land, whereas, the 10 feet pathway had been included and patta was granted for 8.6 cents in 2/5

the name of the father of the third respondent. The petitioner gave a representation only to create this discrepancy in the patta, that was issued in favour of the father of the third respondent. Since the same was not considered, the present writ petition was filed. 4.Heard, the learned counsel appearing for the petitioner and the learned Government Advocate appearing on behalf of the first and second respondents.

5.Taking into consideration the facts and circumstances of the case and nature of grievances that was expressed by the petitioner, there shall be a direction to the second respondent to deal with the representation of the petitioner dated 18.08.2021, after affording opportunity to the petitioner and the third respondent and final orders shall be passed, on its own merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order. The petitioner is directed to make a fresh representation to the second respondent along with the documents and also with the copy of this order.

6.This writ petition is disposed of with the above terms. No costs.
