Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondent herein to permit the petitioner to participate in the public auction cum tender to be conducted on 17.07.2025 at 10 to 11 am for leasing out of newly constructed commercial shops at Ramanathapuram Bus Stand vide Tender Notice Na.Ka.No.934/2025/A1 dated 30.06.2025. ORDER

This writ petition has been filed for a Mandamus to direct the respondent herein to permit the petitioner to participate in the public auction cum tender to be conducted on 17.07.2025 at 10 to 11 am for leasing out of newly constructed commercial shops at Ramanathapuram Bus Stand vide Tender Notice Na.Ka.No.934/2025/A1 dated 30.06.2025.

2. Heard the learned counsel for the petitioner and the learned Additional Advocate General appearing for the respondent.

3. This writ petition is listed after silp for lunch motion was secured by the learned counsel for the petitioner.

4. In respect of very same tender, orders have already been passed by the Division Bench of this Court in W.P(MD)Nos.19217 and 19348 of 2025 which have been followed by this Court in W.P(MD)Nos.19312 and 19385 of 2025 today.

4a. However, considering the scope of the prayer in this writ petition, I am inclined to direct the respondent to accept the Demand Draft together with the tender documents from the petitioner.

5. This order has been passed despite the objections of the learned Additional Advocate General for the respondent stating that the petitioner has not come forward with Demand Draft by 03.00 p.m., today as per the tender notice bearing Na.Ka.No.934/2025/A1, dated 30.06.2025.

6. Therefore, the petitioner is permitted to produce a Demand Draft towards Earnest Money Deposit by the end of the working hours today which shall be received by the officers under the respondent. The officers under the respondent shall immediately on 17.07.2025 issue the tender documents to the petitioner to submit a bid latest by 10.30 a.m., on 17.07.2025. The respondent shall allow the petitioner to participate in the public auction to be held tomorrow i.e., on 17.07.2025.

7. The learned Additional Advocate General who appears for the respondent shall take steps to telephonically intimate the respondent through the instructing Government Pleader to comply with the above direction of this Court.
