ORDER : The Court made the following order :- The petitioner / Accused No.1, who was arrested and remanded to judicial custody on 31.10.2024 for the offence punishable under Sections 8(c) read with 20(b)(ii)(c), 25, 29(1) and 25 of the NDPS Act, 1985, and 111 of BNS, 2023, in Cr. No.768 of 2024 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 01.11.2024, at about 20.00 hours., based on the secret information, the respondent police went to the occurrence place and found that the petitioner and other accused persons were in illegal possession of 150 kgs of Ganja. Hence the case.

3. The learned counsel for the petitioner would contend that the respondent police have registered a false case against the petitioner. The petitioner is an innocent and he is nothing to do with the alleged offences. He would further contend that at the time of search, the respondent Police have not followed the mandatory procedure under Section 50 of NDPS Act. He is in judicial custody from 31.10.2024. Therefore prayed to grant bail to the petitioner.

The learned Additional Public Prosecutor would submit that this case was registered as against the petitioner and other for the illegal transportation of 150 kgs of Ganja, which are commercial quantity. He would further submit that the investigation has been completed and charge sheet has also been filed. Hence, he strongly opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

Considering the rival submissions made on either side, considering the fact that the quantity of contraband involved in this case is a commercial quantity and further the petitioner has not satisfied the twin condition as per Section 37 of the NDPS Act, hence, this Court is declined to grant bail to the petitioner at this stage.

Accordingly, the Criminal Original Petition is dismissed.
