ORDER

The petitioner is the complainant in STC No.160 of 2022, which was instituted for the offence under Section 138 of NI Act as against the respondent. The respondent / accused has been found guilty by the trial court and sentenced to undergo one year rigourous imprisonment. The accused has not preferred any appeal and therefore, the trial court has issued a non-bailable warrant of arrest as against the respondent / accused. Therefore, the petitioner seeks a direction to the respondent police to execute the warrant.

2.The learned Government Advocate submits that even according to the petitioner, the non-bailable warrant of arrest was issued on 27.05.2025 and the respondent police have not received the warrant sofar. He further submits that their verification shows the accused hails from Mumbai. However, they would collect the warrant and take necessary steps to secure the accused.

4.The Police claim that they have not received the warrant dated 27.05.2025 and the accused is also from Mumbai. Therefore, the respondent police shall take necessary steps to execute the warrant as expeditiously as possible.
