Respondent Prayer: Criminal Original petition is filed under Section 482 of Cr.P.C, to direct the respondent to take necessary steps to issue a lookout circular against the named accused Arul @ Aruldhas in Crime No.872 of 2015 on the file of the respondent and to produce the passport before the learned Judicial Magistrate, Padmanabhapuram as per the condition No.3 of the bail order dated 06.10.2015.

O R D E R

The petitioner is the defacto complainant in Crime No.872 of 2015 on the file of Thuckalay police station, Kanyakumari District. Arul @ Aruldhas is the accused. The petitioner wants lookout circular to be issued against him. The case of the petitioner is that even though the accused was directed to surrender his Passport, he has not done so. The petitioner's counsel states that he may leave India, even without the direction of the Court.

2. The learned Government Advocate(Crl. Side) pointed out that the accused has filed Crl.O.P.(MD)No.5379 of 2017 for quashing the proceedings against him. This Court had also dispensed with the personal appearance of the accused. 3. It is open to the petitioner to project the grievances when the said criminal original petition is taken up for consideration. With this liberty to the petitioner herein, the criminal original petition stands dismissed.
