2. Service is complete on R5 and the description printed in the cause list.

However, none appears for R5.

3. Hence, and for the reasons stated in the affidavit accompanying the Miscellaneous Petition, the delay of 285 days in filing the Writ Appeal is condoned and the Miscellaneous Petition is ordered.

4. Registry is directed to number the Writ Appeal, if it is otherwise in order, and list the same for admission. The name of the learned counsel, who entered appearance now, and the description of R5 will continue in the cause list as and when the matter is listed.
