PRAYER :- For Bail in Crime No.181 of 2022 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 11.06.2023 for the alleged offence under Sections 457 and 380 of IPC, in Crime No.181 of 2022, on the file of the 1/4

respondent police, seeks bail.

2.The case of the prosecution is that the defacto complainant lodged a complaint stating that on 31.07.2022, she locked her house and went to meet her friend. On the same day, when she returned to her home, she found that the lock of her house was broken and gold jewels worth about Rs.11,00,000/- was stolen by some body. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. This is his third application. Earlier two applications filed by the petitioner were dismissed by this Court. The occurrence taken place on 31.07.2022, for which, the petitioner was arrested on 11.06.2023. He is in judicial custody for about 90 days.

4.The learned Additional Public Prosecutor submitted that there two previous case pending against the petitioner.

5.Though the petitioner is having two previous cases for the offence under Section 379 of IPC, considering the period of incarceration and the petitioner is entitled for statutory bail, this Court is inclined to grant bail to the petitioner with conditions.

6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Nilakottai, Dindigul District and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
