O R D E R

[Order of the Court was made by D.KRISHNAKUMAR, J.] This Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the 2nd respondent herein to consider the representation of the petitioner dated 09.12.2013 and to take necessary action against the 4th and 5th respondents herein.

2. The Writ Petitioner being a practising advocate has filed this Writ Petition as a Public Interest Litigation seeking for a direction to the respondents

to take necessary action against the respondents 4 and 5, who were misappropriated the money belongs to the Mamsapuram Town Panchayat by doing the act of fabricating forged vouchers and irregularities in giving water pipe connections. In this regard, the petitioner has also made a representation on 09.12.2013. Since no action has been taken, the petitioner has approached this Court by filing this Writ Petition.

3. The learned Government Pleader appearing for the respondents 1 to 3 submitted that punishment order has been issued as against the respondents 4 and 5 and they were also retired from service and therefore, nothing survives in this Writ Petition.

4. In view of the submissions made by the learned Government Pleader, no further orders is required in this Writ Petition and hence, this Writ Petition is liable to be dismissed.

5. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs.
