ORDER

This petition has been filed seeking a direction to the respondent to file a final report in Crime No.356 of 2017 dated 21.06.2017 on the file of the respondent within a time stipulated by this Court.

2. When the matter is taken up for hearing, the learned counsel for the petitioner would submit that the petitioner is the defacto complainant. Based upon his complaint, a case in Crime No. 356 of 2017 has been registered for the offences punishable under Sections 294(b), 323, 506(1) IPC, 1860 and Section 4 of Tamil Nadu Prohibition of Harassment of Woman Act, 2002. The learned counsel for the petitioner submits that even after lapse of 3 years, there is no progress in the investigation. Hence, this petition.

3. The learned Additional Public Prosecutor would submit that investigation has been completed and final report was also filed before the concerned court on 21.06.2017 itself as mistake of fact.

4. Since the case has been closed as mistake of fact, the petitioner is at liberty to work out his remedy thorough appropriate proceedings before the appropriate court. In the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.17008 of 2021 meantime, the learned counsel for the petitioner may get copy of the closure report from the Public Prosecutor's Office.

5. With the above said liberty, this petition is disposed of.
