O R D E R
This petition has been filed to direct the Respondent No.1 to 3 to transfer the investigation relating the case in Crime No.20 of 2018 on the file of the fourth respondent to anyone of the Inspector of Police to complete the investigation, within a time stipulated by this Court.
2. Based on a complaint lodged by the petitioner, dated 05.04.2018, a case in Crime No.20 of 2018 was registered by the fourth respondent for the offences under Sections 147, 148, 294(b), 1/3
342, 323, 324 & 506(2) of I.P.C.
3. The only grievance of the petitioner is that the fourth respondent did not register a case based on the complaint lodged by the petitioner, only after direction issued by this Court the fourth respondent has registered a case. The fourth respondent did not even take action against the accused persons.
4. The learned Government Advocate (crl. Side) submitted that all the accused were arrested except A3, A4 and A7 and remanded them to judicial custody. They are waiting for wound certificate and about to complete entire investigation.
5. Considering the facts and circumstances of the case, now this stage, change of investigation would affect the entire investigation and therefore, the prayer sought for by the petitioner cannot be granted. However, the fourth respondent is directed to complete the investigation and file a final report, within a period of Four months, from the date of receipt of a copy of the order. The third respondent is directed to monitor the investigation done by the fourth respondent and also ensure that the fourth respondent shall file a final report, within a time stipulated by this Court.
6. With the above directions, this criminal original petition is disposed of.
