PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ Certiorarified Mandamus, calling for the entire records connected with the impugned order dated 10.07.2025 passed by the third respondent and quash the same, consequently directing the respondents to grant permission 1/5

The petitioner, claiming to be the District President of Ainthinai Makkal Katchi, Virudhunagar has submitted a representation to the third respondent, seeking permission and police protection for conducting protest/demonstration on 11.07.2025, near Nehru Statue at Panchu Market, with regard to the custodial death of one Ajith Kumar, a security guard of Madampuram Temple, Thirupuvanam, Sivagangai District and the same was rejected by the respondent police, by his order, dated 10.07.2025. Challenging the same, the petitioner has approached this Court. 2.Mr.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, who takes notice for the respondents submits that there will be ''Aadi Pooram'' festival in Srivilliputhur 2/5
Andal Temple in this month and the major police force have to be deployed to the temple, in order to maintain order, managing traffic, and preventing any potential disruptions and therefore, they are not in a position to provide police protection as required by the petitioner to conduct the protest. However, they are prepared to provide police protection, if the petitioner changes the date of protest to the first week of August 2025.
3.Recording the submissions of the learned Additional Public Prosecutor, this writ petition is closed with liberty to this petitioner to file a fresh application changing the date of protest and the same shall be considered by the respondent police, imposing necessary restrictions/conditions. No costs.
