PRAYER :- Review Application filed under Order 47 Rule,1 and 2 of CPC to review the order passed in CMSA(MD) No. 22 of 2015 dated 19.03.2024 on the file of this Court.
For Petitioner : Mr.V.Sasikumar For Respondent : Mr.S.Mahendrapathy ORDER : The Court made the following order :- These petition have been filed to review the common order passed in CMSA(MD) Nos. 21 and 22 of 2015 dated 19.03.2024 on the file of this Court.
2. This Court on 19.03.2024 in the main petition passed orders on merits by allowing the Civil Miscellaneous Appeal. The grounds raised by the petitioner is that with regard to the complaint given before All Women Police Station, Kulithalai in CSR No.266 of 2014 on 21.12.2024 have not been produced before the trial Court. The respondent disconnected the electricity connection inorder to driven out the petitioner from the matrimonial home, it was not placed before the Court at the time of arguments. The respondent attacked the petitioner on 2/5
13.08.2015 and she was admitted in the Head Quarters Hospital, Manaparai and the same was reported to the learned Judicial Magistrate No.I, Kulithalai and the learned Magistrate had directed the Protection Officer under the Domestic Violence Act, 2015 to inspect the hospital and file a report , which was also not brought to the knowledge of the Court, therefore the common order passed by the Court has to be reviewed.
3. Heard both sides and perused the materials available on record.
4. This Court after hearing both the parties passed orders on merits and now the ground raised by the petitioner cannot be considered as those grounds have not been raised either during the proceedings before the first appellate Court and this Court already passed orders on merits and if the petitioner is aggrieved by the orders of this Court he has to file appeal before the Hon'ble Apex Court and without approaching the Hon'ble Apex Court filed this review petition and there are no grounds to review the common order pass by this Court, hence these petitions have no merits and deserves to be dismissed. 3/5
