PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents 1 and 2 to issue separate Patta in the petitioner's name for an extent of 1.2 acre comprised in Survey No. 1679/1 situated at Vadamadurai Village, Vedasandur Taluk, Dindigul District without insisting any no objection certificate from the respondents 3 to 5 by considering the representation dated 26.03.2025. 1/5

ORDER
The petitioner contends that his father in law owned 2.21 acres in S.No. 1679/1 at Vadamadurai Village. Out of the total extent, it is stated that 1.19 acres were conveyed to the Sri Soundharaja Perumal Temple and that the remaining extent of 1.02 acres were retained by the writ petitioner's father in law. By asserting that the said extent of 1.02 acres is in the absolute possession and enjoyment of the petitioner, the petitioner had submitted a request to the Tahsildar for grant of separate patta in respect of such extent. The present writ petition relates thereto.
2. Learned counsel for the 5th respondent submits that an appeal has been filed before the Revenue Divisional Officer for deletion of the name of the petitioner from patta No.770. On account of the pending appeal, he submits the the petitioner's request cannot be considered at this juncture by the Tahsildar. 2/5
3. Learned Additional Government Pleader submits that the Revenue Divisional Officer would consider and dispose of the pending appeal on merits.
4. In the above facts and circumstances, it is just and necessary that the pending appeal be disposed of expeditiously by the Revenue Divisional Officer. Accordingly, the Revenue Divisional Officer is directed to consider and dispose of the appeal filed by the 5th respondent within two months from the date of receipt of a copy of this order. After providing a reasonable opportunity to the petitioner and the 5th respondent, a speaking order shall be issued. In case the petitioner were to succeed, the Tahsildar shall consider the request of the petitioner for a separate patta in respect of 1.02 acres and issue separate patta within one month from the date of receipt of the order of the Revenue Divisional Officer. No costs.
