PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to transfer the investigation from the file of the 3rd respondent in connection with Crime No.38 of 2019 and entrust the same to the respondents No.2 and 4 for the fair investigation of the case, so that filing final report within the time stipulated by this Honourable Court.

ORDER

This petition has been filed to transfer the investigation from the file of the 3rd respondent in connection with Crime No.38 of 2019 and entrust the same to the respondents No.2 and 4 for the fair investigation of the case.

2. Today, when the matter is taken up for hearing, the learned Government Advocate(Crl.Side) would submit that the third respondent police has completed investigation and about to file final report. Crl.O.P.(MD) No.13776 of 2019 stage, it will affect the entire investigation done by the third respondent.

3. Under such circumstances, the transfer of investigation cannot be considered at this stage. In the result, the Criminal Original is dismissed and the third respondent is directed to complete the investigation and file final report within a period of twelve weeks from the date of receipt of a copy of this order.
