PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :- For Bail in Crime No.68 of 2023 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioner, who is arrayed as sole accused arrested, on 03/03/2023 and remanded to judicial custody for the offence punishable under section 174 Cr.P.C @ 302 IPC, in Crime No.68 of 2023 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the deceased is the paramour of the petitioner. Suspecting the character of the deceased, the petitioner assaulted and murdered her. Hence, the case.

3.Heard both sides.

4.The earlier applications that were filed by the petitioner were dismissed by this Court, dated 10/07/2023, directing the committal Court to complete the committal process within a period of 15 days from the date of receipt of a copy of this order. After that, the concerned trial court shall complete the trial process and dispose of the case within a period of five months thereafter.

5. This bail application has been filed on the ground that the petitioner's fatherin-law is admitted in hospital for medical treatment and the petitioner has to take care of him.

6. Considering the gravity of offence and there is no change of circumstances and even though the petitioner's father-in-law is admitted in the hospital, that cannot be a ground for enlarging the petitioner on bail. The petitioner shall co-operate with the trial Court to complete the trial process.

7. With the above said direction, this Criminal Original Petition stands dismissed.
