ORDER

This Writ Petition has been filed seeking a Writ of Mandamus, directing the respondents 1to 3 respondents to consider, conduct proper enquiry upon the petitioner's complaint, dated 13.03.2024 and dispose the same within the time frame as fixed by this Court.

2. When the matter is taken up for hearing today, the learned counsel for the petitioner would submit that the petitioner has lodged a complaint as early as on 13.03.2024, but no action has been taken and he filed the present petition.

3. The learned Additional Public Prosecutor appearing for the State would submit after receipt of the petitioner's representation, they have forwarded the same to the Tahsildar and awaiting for report. 2/4

4. Considering the facts and circumstances of the case, this Court is at loss to understand as to why the police, without conducting enquiry by themselves, has forwarded the complaint to the Tahsildar, when a specific complaint was made that the private respondents are taking sand unauthorizedly in the petitioner's patta land. Hence, the third respondent is directed to consider the petitioner's representation and take a decision within a period of three days from the date of receipt of copy of this order.

5. With the above direction, the Writ Petition is disposed of. No costs.
