For Respondent : Mr.M.Vaikkam Karunanithi Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.270/2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.2, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379 of IPC read with 21(1) Mines and Minerals (Development and Regulation) Act, 1957 in Cr.No.270 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner was in illegal possession of 1/4 unit of river sand in a bullock cart. Hence the complaint.

3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case and pray the petitioner to be released on anticipatory bail. https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD).No.16123 of 2022 4.The learned Government Advocate(Crl.side) submitted that there are totally two accused in this case. The petitioner is having two previous cases and pray the petition to be dismissed. 5.Considering the facts and circumstances of this case and considering the nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this petition is dismissed.
