Mr.D.RAMESHKUMAR, Advocate for the petitioner and of Mr.T.SENTHIL KUMAR, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- The Criminal Miscellaneous Petition has been filed seeking to relax the condition imposed in Crl.M.P(MD)No.11411 of 2023 filed by the petitioner herein in Crl.A.(MD)No.702 of 2023, which condition was imposed by order, dated 28.06.2024. By such condition, while granting suspension of sentence, a Division Bench of this Court had directed the petitioner to sign before the Inspector of Police Tallakulam Police Station, Madurai, everyday at 10.30 a.m.
2. This Criminal Miscellaneous Petitio has been filed stating that the petitioner had been continuously complying with such condition on and from 11.07.2024 and that he is a resident of Aranthangi, Pudukottai District and staying at Madurai has caused much financial difficulties.
3. It is stated by the learned counsel for the petitioner that the petitioner would abide by any condition imposed in Aranthangi itself.
4. Heard Mr.T.Senthil Kumar, learned Additional Public Prosecutor also. 5.Taking into consideration all the factors, we would relax the condition or modify the same by directing the petitioner to appear and sign before the Judicial Magistrate Court, Aranthangi in Pudukottai District, every Monday at 10.30 a.m., until disposal of the Criminal Appeal.
