For Respondent : Mr.B.Nambiselvan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.219 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/accused who apprehends arrest at the hands of the respondent
police for the offences punishable under sections 109, 302, 324, 341 and 506(ii) of I.P.C., in Crime No.219 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the defacto complainant's son had love affair with a girl belongs to the first accused person's family. Over which dispute arose between them. Therefore, one day i.e., on 15.05.2023, she found his son dead in a well and came to understand that he was murdered by the accused persons by cutting his throat. Hence, the complaint.
3.On the ground that the petitioner is not directly involved in the above said murder of the deceased, this petition has been filed, stating that he is neighbouring land owner. Because of that he has been implicated in this case. 4.The learned Government Advocate (Crl. Side) would submit that as per the allegation, he watched the movement of the deceased and informed the same to the co-accused. On that ground he was implicated. Apart from that the petitioner is having 10 previous cases. Most of the cases are assault cases. 5.Considering the bad antecedents of the petitioner and also considering the overt act attributed against the petitioner, he is not entitled to any discretionary relief from this Court.
6.Let the petitioner surrender before the respondent police and co-operate with them to complete the process of investigation. 7.With the above said directions, this criminal original petition stands dismissed.
