ORDER
The petitioner herein seeks a direction to the first respondent to expedite his appeal pending on the file of the first respondent. 2.Heard the arguments of Mr.R.Paranjothi, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 and 2. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3. According to the petitioner, his mother, Nallammal purchased the properties situated in Survey Nos.809/9, 815/10 and 817/7, in
Karaiyur Revenue Village, Ponnamaravathy Taluk, Pudukkottai District, under registered sale deed dated 25.02.1971. After death of his mother, the petitioner submitted an application seeking transfer of patta in his name. The said application was rejected by the second respondent by order dated 24.02.2023. Aggrieved by the same, the petitioner filed an appeal before the first respondent on 30.03.2023. The said appeal has not been considered till date. Therefore, the petitioner has come before this Court.
4.The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the appeal is pending on the file of the first respondent and there is a delay in disposal of the appeal due to the death of the fourth respondent.
5.In view of the same, the petitioner is directed to take steps to implead the legal heirs of the deceased fourth respondent in the pending appeal before the first respondent within a period of three weeks from the date of receipt of a copy of this order. The first respondent shall consider
the appeal filed by the petitioner and pass final orders within a further period of twelve weeks, after issuing notice to the petitioner, third respondent and legal representatives of the deceased fourth respondent.
