ORDER

This criminal original petition has been filed for quashing the impugned proceedings. When the matter was taken up for hearing, the learned counsel appearing for the defacto complainant states that trial has substantially progressed and the Investigation Officer alone remains to be examined. Therefore, the question of quashing impugned proceedings at this stage will not arise. Leaving open all the contentions and defences and without going into the merits of the case, this criminal original petition stands dismissed.

2.However, the personal appearance of the petitioner is dispensed with before the court below. Of course, the petitioner has to appear at the time of examination under Section 313 of Cr.Pc https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl OP(MD)No.6240 of 2015 and again at the time of pronouncement of judgment. On all other occasions, the petitioner shall be represented by their counsel before the court below.
