For Respondent : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER:- For Anticipatory Bail in Crime No. 28 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the respondent.

2. The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 147, 148, 294(b), 323, 324 and 506(ii) of I.P.C., and Section 4C of TNPWH Act, in Crime No.28 of 2021 on the file of the respondent police, seek anticipatory bail.

3. The petitioners were earlier granted anticipatory bail by the Principal District and Sessions Judge, Sivagangai. It was also later modified vide order dated 17.03.2021. It is stated that due to prevalence of Covid-19 pandemic, the petitioners could not furnish the sureties. As a result, the earlier orders got themselves worked out. Hence, this fresh petition has been filed.

4. Since the petitioners had already been granted relief, taking note of the overall facts and circumstances, I am inclined to grant anticipatory bail to the petitioners with certain conditions.

CRL OP(MD) No.17225 of 2021 Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate Court, Singampunari, Sivagangai District, and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two common sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.

5. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
