Pleased to allow this Second Appeal with costs and to set aside and reverse the judgement and decree of the Learned Additional District Judge-cum-Chief Judicial Magistrate, Tanjore, Kumbakonam in A.S.No.7 of 1999 dated 30.11.1999 reversing the judgement and decree of the Subordinate Judge, Kumbakonam in O.S.No.128 of 1991 dated 18.01.1999 and dismiss the same.

ORDER : This Civil Miscellaneous Petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.N.DILIP KUMAR, Advocate for the petitioner and of Mr.C.MURUGAN, Advocate on behalf of the Respondents, the court made the following order:- This petition is filed to extend the time granted by this Court in CMP(MD). No.855 of 2023, dated 11.07.2023 for the payment of cost of Rs.5,000/- before the Registry.

2. Heard both sides.

3. For the reasons stated in the accompanying affidavit filed in support of this petition, this petition is ordered and the time is extended till 05.02.2024 for payment of cost of Rs.5,000/- imposed in CMP(MD).No.855 of 2023.
