For Respondent : Mr.RMS.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.22 of 2022 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 420 and 353 of IPC, in Crime No.22 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner had misappropriated the Government fund to the tune of Rs.4,49,724/-. 3.The earlier application filed by the petitioner was dismissed on the ground that custodial interrogation is necessary to find out how aforesaid offence said to have taken place. This is the second application of the petitioner.

4.The learned counsel for the petitioner submitted that the misappropriated fund of Rs.4,49,724/- has been recovered from the Officials and this petitioner was working as temporary Staff in the aforesaid scheme. Hence, the petitioner was not at all involved in https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.16257 of 2022 this serious issue, which involves funds released by the Central Government.

5. Considering the aforesaid facts, this Court is of the view that when there is misappropriation of funds, it requires thorough investigation. The persons, who are involved in this crime must be subjected to custodial interrogation. This nature of offence cannot be lightly taken. I find absolutely no ground to exercise the jurisdiction. Accordingly, this Criminal Original Petition is dismissed.
