Heard Mr.S.Balaji, learned counsel for the Petitioner and Mr.K.S.Kathiravan, learned Counsel for the respondent.

2. The learned Counsel for the Petitioner submits that this Civil Miscellaneous Petition has been filed under Section 5 of the Limitation Act, 1963, seeking to condone the delay of 74 days in preferring a restoration petition to restore the Tr.CMP(MD).No.39 of 2025 dated 04.04.2025.

3. Mr.K.S.Kathiravan, learned Counsel for the respondent, has stated that he has no objection in allowing this petition.

4. Being satisfied with reasons stated in the affidavit filed in support of this Civil Miscellaneous Petition, the delay of 74 days in preferring a restoration petition to restore the Tr.CMP(MD).No.39 of 2025 dated 04.04.2025 is condoned.

5. Registry is directed to number the restoration petition, if any and list the same in the usual course.
