Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Declaration declaring the entire selection process of the second respondent in his proceeding in Na.Ka.No. 1/6

R3/1101/2024 dated 11.04.2025 for filling up 273 posts of Noon Meal Cooking Assistant Vacancies is illegal.

ORDER

This writ petition has been filed seeking declaration declaring that the entire selection process of the second respondent in his proceeding in Na.Ka.No. R3/1101/2024 dated 11.04.2025 for filling up 273 posts of Noon Meal Cooking Assistant Vacancies is illegal.

2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

The learned counsel for the petitioner would submit that the petitioner is a resident of Ramalingapuram village, situated 2 kms away from the fourth respondent School, and has studied up to 10th standard. There were 273 vacancies for the post of Noon Meal Cooking Assistant in Virudhunagar District, including 23 vacancies in Aruppukottai Panchayat Union, in which the fourth respondent School was also included. To fill up the said vacancies, the second respondent issued a 2/6

notification dated 11.04.2025. The petitioner applied for the said post, and her application was acknowledged by the third respondent on 16.04.2025. However, she was not called for the interview, and the second respondent did not disclose any reason for not issuing a call letter. The learned counsel for the petitioner further submitted that the petitioner belongs to the Backward Community. She enclosed all the required documents such as Transfer Certificate, 10th standard mark sheet, Community Certificate, and Ration Card, as mandated in the notification Aggrieved thereby, the petitioner has filed the present writ petition.

On the other hand, the learned Special Government Pleader appearing for the respondents submitted that as per the notification, the fourth respondent School was allotted one post under the General Turn - Priority Category. The petitioner does not fall under the priority category and comes only under the general category. For the said post, three candidates applied under the priority category, namely, Selvi and Saranya (destitute widows) and R. Saranya Devi (deserted by her husband). However, no candidate has been selected so far due to the pendency of this writ petition.

5. It is seen that if the petitioner has any grievance, her remedy lies in challenging the selection of the candidate appointed in the fourth respondent School. Since the post itself is reserved for the priority category, and the petitioner admittedly belongs only to the general category, she is not eligible.

6. Accordingly, the Writ Petition stands dismissed. No costs.
