COMMON PRAYER: Writ petitions filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the respondents to pass an order on the petitioner's renewal applications dated 18.08.2010, 03.09.2015 and 27.11.2015 respectively in respect of his mini buses bearing Registration No.TN23-X 1290, plying on the route Krishnapuram Pirivu Road to Keezhakalkandarkottai and Registration No.TN 04-C1179, plying on the route Notchivayalpudur to Udkadai Aathupalam. For Petitioner : Mr.A.C.Asaithambi (in both W.Ps.) For Respondents : Mrs.J.Padmavathi Devi, (in both W.Ps.) Special Government Pleader.
COMMON ORDER The petitioner is having permit to ply mini buses between Gandhi Fish Market to Keezhakalkandarkottai and between Notchivyalpudur to Palpannai. The permit was valid for a period from 01.08.2003 to 28.09.2005 and from 09.08.2004 to 15.12.2005. Thereafter, he submitted his renewal application. However, that renewal application was not considered and he continuously plied the buses by using temporary permit.

No.TN23-X 1290, plying on the route Krishnapuram Pirivu Road to 2.The reason for non-consideration was that there was bifurcation of 2nd and 3rd respondent Regional Transport Office and papers were transferred to the jurisdiction of the authority concerned to grant permit. The respondents filed their counter stating that they will consider the application, after conducting joint inspection of the route and after conducting enquiry in this regard.
3.Considering the above facts and circumstances of the case, a direction is given to the respondents to consider the application of the petitioner by following due process of procedure laid down in the statutory and pass orders, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
4.With the above directions, these Writ Petitions are disposed of. No costs.
