Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the second respondent to conduct the tender as per the notification Na.Ka.No.174/2023/A1 dated 03.07.2023 for four works such as put up Thar Road at Christianagaram North Street, to put up paverblock Road at Santhaiyadiyur Mutharmman Kovil North Street and to put up Paverblock at Nadukalankudiruppu North Street and Thisayanvilai Road by considering the petitioner's representation dated 23.07.2023 within stipulated time fixed by this Court.

The petitioner said to have participated in the tender notified by the second respondent and has filed this writ petition for a Mandamus, directing the second respondent to conduct tender as per the notification dated 03.07.2023.

2.The learned counsel appearing for the petitioner submits that by notification dated 03.07.2023, the second respondent has notified tender for several works. On the date of tender i.e on 21.07.2023, the second respondent has withheld the tender process for four weeks on certain technical grounds and they have not proceeded further after that. The grievance of the petitioner is that he has participated and also submitted his tender document for certain works as per the tender notification dated 03.07.2023. Though the petitioner has approached the respondents for several times, the auction has not been conducted.
3.Mr.M.Sarangan, learned Additional Government Pleader, who takes notice for the respondents on written instructions submits that the tender process was withheld on 21.07.2023 on technical ground and re-scheduled and will be held on 10.08.2023. 3/6
4.Recording the submissions of the learned Additional Government Pleader, this writ petition is closed with a liberty to the petitioner to participate in tender on 10.08.2023. No costs. 07.08.2023 NCC : Yes / No.
